Hierbij komt het aan op het doel en de strekking van die rechtsplicht, aan de hand waarvan moet worden onderzocht tot welke personen en tot welke belangen de daarmee beoogde bescherming zich uitstrekt.2 Het doel van artikel 107 VwEU is \u2013 zoals de omwonenden zelf ook aanvoeren \u2013 om nadeel van de marktbe\u00efnvloeding door overheidssteun te voorkomen. De omwonenden exploiteren echter geen onderneming die met het Leger des Heils concurreert, zodat hun belang niet wordt beschermd door artikel 107 VwEU. Voor zover de omwonenden zich op het algemeen belang willen beroepen helpt hen dat niet omdat dat belang, naar vaste jurisprudentie, niet hoort tot de belangen die artikel 6:162 BW (onrechtmatige daad) beoogt te beschermen. (\u2026)<\/p>\n<p>De omwonenden stellen tot slot dat de Gemeente onrechtmatig handelt door de opdracht voor de opvang van daklozen niet aan te besteden. De Gemeente betwist dat zij de opvang had moeten aanbesteden. De voorzieningenrechter laat dat in het midden, omdat ook in dit opzicht niet is voldaan aan het vereiste dat de rechtsplicht waarvan naleving wordt gevorderd moet strekken tot bescherming van het belang waarin de omwonenden zijn of dreigen te worden aangetast. Het doel van EU richtlijn 2014\/24\/EU, waarin de aanbestedingsplicht is geregeld, is om alle ondernemers een eerlijke kans te geven om een overheidsopdracht te winnen. De omwonenden zijn echter geen ondernemers die zich bezig houden met de daklozenopvang. Het doel van de richtlijn strekt dus niet tot bescherming van belang waarin de omwonenden stellen te worden aangetast.<\/p>\n<p>Zie voor het vonnis:
