Appellanten kunnen zich hierop beroepen, aangezien het exploitatieplan onderdeel is van het tijdelijk deel van het omgevingsplan (zie onder 4.2) en daarom op grond van de artikelen 5.18, eerste lid, van de Ow en artikel 8.0a, eerste lid, van het Besluit kwaliteit leefomgeving een weigeringsgrond vormt voor de verlening van een omgevingsvergunning en een basis voor een verzoek om handhaving., Gelet hierop is het voor regels die nodig zijn vanuit een oogpunt van een evenwichtige toedeling van functies aan locaties, zoals hier aan de orde (zie onder 7.3), vanwege het rechtszekerheidsbeginsel onvoldoende dat zij uitsluitend onderwerp zijn van privaatrechtelijke afspraken. Dergelijke afspraken bieden onvoldoende afdwingbare waarborgen voor derden die afhankelijk zijn van een publiekrechtelijke regeling die waarborgen biedt voor hun rechtspositie. Daarbij betrekt de Afdeling dat, hoewel de raad en GEM Bloemendalerpolder terecht stellen dat voor het kostenverhaal geldt dat privaatrechtelijke afspraken volgens de wetgever de prioritaire weg zijn (o.a. Kamerstukken II 2004\/05, 30 218, nr. 3, p. 25), dit, gelet op de geheel andere aard van de regels, niet het geval is voor regels die nodig zijn vanuit een oogpunt van een evenwichtige toedeling van functies aan locaties. Dit heeft dus ook gevolgen voor een besluit tot intrekking van zulke regels.
