Deze bevoegdheid sluit echter niet de mogelijkheid uit om privaatrechtelijke afspraken te maken over dergelijk gebruik, inclusief het bedingen van een vergoeding daarvoor. De mogelijkheid van het heffen van precariobelasting is afhankelijk van de privaatrechtelijke situatie en vervult een vangnetfunctie, zodat het toepassen of aanbieden van een privaatrechtelijke gebruiksregeling uit de aard daarvan geen onaanvaardbare doorkruising van de regeling van de precariobelasting kan opleveren.11 Tot aan de datum waartegen door het Waterschap is opgezegd was er \u00f3\u00f3k sprake van een (stilzwijgende) privaatrechtelijke afspraak over het gebruik. Het Waterschap mocht deze privaatrechtelijke afspraak opzeggen (zie onder 3.13 tot en met 3.17) en het staat het Waterschap in beginsel vrij de ontruiming van het waterperceel te vorderen als [appellanten] niet willen overgaan tot het sluiten van een huurovereenkomst voor de ligplaatsen. De suggestie van [appellanten] dat vervolgens dubbelop zou worden betaald als een huurovereenkomst wordt aangegaan, omdat er sprake zou zijn van een privaatrechtelijke vergoeding naast precariobelasting, is onjuist. Het Waterschap heeft onweersproken aangevoerd dat er nadrukkelijk voor is gekozen g\u00e9\u00e9n precariobelasting te heffen. Het hof sluit zich verder aan bij de overweging van de rechtbank dat het Waterschap voldoende heeft gemotiveerd waarom zij kiest voor de privaatrechtelijke weg en niet voor de publiekrechtelijke, door te verwijzen naar zijn beleid dat inhoudt dat het Waterschap met alle woonarkbewoners die ligplaats hebben in bij hem in eigendom zijnde wateren een huurovereenkomst wil sluiten. In dat beleid is deze keuze uitgebreid toegelicht.
