De regels uit het Didam-I arrest richten zich specifiek op situaties waarin een overheidsinstantie een schaars recht of onroerende zaak beschikbaar stelt op de markt. Daarbij kan gedacht worden aan uitgifte, verkoop of nieuwe verhuur. Bij het opzeggen van een lopende huurovereenkomst is naar het oordeel van de kantonrechter (nog) geen sprake van het beschikbaar stellen van een schaars recht of onroerende zaak. Het feit dat door een geldige opzegging onroerend goed vrijkomt waarop de Didam-regels mogelijk van toepassing zijn, maakt niet dat deze regels ook bij de opzegging zelf in acht moeten worden genomen.
