Op basis van deze prompt heeft ChatGPT een tekst gegenereerd waarin onder meer de naam van een verschoningsgerechtigde wordt genoemd. Aannemelijk is dat deze tekst bestemd is voor communicatie met een verschoningsgerechtigde. De rechter-commissaris overweegt ten aanzien van deze gegevens het volgende.<\/p>\n<p>Aan het verschoningsrecht ligt ten grondslag dat het maatschappelijk belang dat de waarheid in rechte aan het licht komt, moet wijken voor het maatschappelijk belang dat eenieder zich vrijelijk en zonder vrees voor openbaarmaking van het toevertrouwde om bijstand en advies tot de betreffende beroepsbeoefenaren moet kunnen wenden. Een extern AI-systeem, zoals OpenAI, waarvan ChatGPT een product is, slaat zowel de ingevoerde als gegenereerde informatie op en kan deze vervolgens gebruiken voor bijvoorbeeld het trainen van het AI-model. Het invoeren van (mogelijk) verschoningsgerechtigde informatie in ChatGPT, alsmede het laten genereren van een tekst die bestemd is voor een verschoningsgerechtigde, kan worden aangemerkt als het openbaar maken van dergelijke informatie. Hierdoor wordt de vertrouwelijkheid van deze informatie doorbroken.
